On April 14, 2026, France’s CNIL published Decision No. 2026-042, which makes the recipient’s prior consent the general rule for tracking pixels, with narrow exceptions for authentication, security, and deliverability measurement. I am not a lawyer, so if you email people in the EU, get proper counsel before you switch tracking on.

Can someone tell that I am tracking their email?

The pixel is invisible, so nothing shows up in the message itself. Anyone who blocks remote images, uses a privacy-focused mail client, or runs a tracker-blocking browser extension will either see a warning or simply never register as an open. Assume some share of your list is invisible to you.

Why are my open rates higher than my reply rates suggest?

Apple’s Protect Mail Activity pre-loads remote content in the background whether or not the recipient ever opens the message, and your tracker counts that as an open. Any list with a meaningful Apple Mail share will report inflated numbers. Judge campaigns on clicks and replies instead.
